The Elements of a Tort

For you to be able to get compensatory damages following your accident, a tort must be present.  A tort is made up of four requirements, all of which must have occurred before you can win a settlement or jury verdict.  They are:

  • The existence of duty.  In cases of car accidents, the duty is to obey all of the rules of the road.
  • The breach of this duty.  Failure to follow the rules of the road is a breach of a motorist’s duty.
  • The breach caused an accident.  While a breach of the rule of the road is always illegal, a tort has not occurred unless the breach of duty directly caused an accident.

Injury resulted from the accident.  For a tort to have been committed, the accident must have directly caused injury.
